Probate and Guardianship Retainers and Fees
All retainers are paid at the execution of the Client Services Contract. Retainers are deposited into Trust where they are used to pay case expenses and attorney fees. Prepaid retainer remaining in the trust at the conclusion of the legal matter is returned to the client. Upon depletion of the retainer, clients are requested to replenish the retainer in an amount included in the client services contract.
Attorney Fees are billed at tenths-of-hours increments, eliminating the expensive and inefficient practice of a quarter-hour minimums†that most practices employ.
Common case expenses include filing fees, service fees, publication fees, courier fees, postage, copies, and publication fees. Other case expenses may occur depending on the legal matter, including consulting expert fees, testifying expert fees, private investigation, genealogy, genetic testing, and more. Extraordinary case expenses will be disclosed to and approved by the client before fees are incurred.
Filing Fees in some cases can be significant and may require a larger portion of retainer than others. We will discuss this with you during the intake process.
Some cases require the appointment of an Ad Litem Attorney. Ad Litem fees are billed separately by the Ad Litem and are not included in the retainer.
